TERMS OF STAY AT THE ARTISTIC RESIDENCY IN KERMINY
Introduction We, the collegial presidency of the OPEN association, declare that members hosted at the Château de Kerminy during an artistic residency are indeed members of the association. The Château de Kerminy is a private space that is not open to the public. The château's outbuildings (workshops, Ecosomat space) are managed by partner associations and may only receive visitors occasionally during events, workshops, or one-off activities. Any activity open to the public must be authorized in advance by the association OPEN and must comply with applicable safety regulations.
Conditions for Using Spaces
Creative activities during residencies are organized among adult members who are professionals or semi-professionals, responsible, and autonomous.
Only professional and semi-professional artists who are up to date with their membership fees may access the château's private spaces.
Each resident must consult and adhere to the recommendations provided by the permanent staff and follow the fire safety instructions displayed in the various spaces.
Failure to comply with safety rules may result in immediate exclusion from the residency.
Insurance and Responsibilities
The association OPEN has taken out civil liability insurance, which covers only damages for which the association would be responsible in the residency spaces: château, immediate surroundings, and the adjacent terrace garden.
Annex buildings, outbuildings, market garden areas, and workshops are not accessible to OPEN residents without specific authorization.
Each member must take out personal liability insurance covering their artistic activities and personal belongings.
The association OPEN disclaims all responsibility in the event of theft, loss, or deterioration of residents' personal belongings.
Any damage caused by a resident is their responsibility and may result in a repair charge.
Responsibility in case of bodily injury: Each resident agrees to comply with local regulations, particularly regarding fire safety and hygiene standards (including food hygiene). Each member is responsible for preparing their own meals; the association OPEN cannot be held responsible in the event of food poisoning or any other incident related to food preparation.
Force Majeure Clause: OPEN cannot be held responsible for the cancellation or disruption of the residency in the event of unforeseen circumstances such as major weather events, pandemics, floods, or any other incident beyond its control.
In the event of a collective stay organized by a school, company, or any other group, the group leader must provide a certificate of civil liability insurance covering the group members during their stay. Each participant remains individually responsible for their actions and their belongings. The association OPEN cannot be held responsible for incidents resulting from individual or collective negligence. The group leader is also responsible for ensuring that all participants receive the residency conditions, the welcome booklet, practical information, and the logbook for the site.
Community Life and Contributions
Space maintenance and upkeep: Residents are required to keep the premises clean and tidy after each use. They must also ensure that the spaces are returned to their original condition and that no objects or materials are left on site.
Participation in community life: Each resident is encouraged to share their work with the community, organize presentations, or contribute to the organization of the space.
Safety: The use of dangerous equipment or flammable products must be reported to the association and must strictly adhere to the safety protocols in place. The use of candles is strictly prohibited in the upper floors of the château, as well as fires in the forest or wooded areas to prevent fire hazards.
Access and hosting the public: It is strictly forbidden to invite external visitors or minors without express authorization from the association.
Voluntary nature of contributions: Collective tasks carried out as part of the OPEN residency are voluntary and cannot be remunerated, thus avoiding any risk of reclassification as undeclared work.

Respecting the above-presented residency conditions.
Coming to work on my personal professional project and participating in the association's activities in a spirit of exchange and reciprocity.
Taking out personal liability insurance covering any damages for which I may be responsible.
Respecting the safety instructions, community living rules, and ensuring that I do not involve the association OPEN in unauthorized activities (both inside and outside of Kerminy).
Acknowledging that I have taken note of the characteristics of the site, including its natural spaces, the age of the château, and its furniture, and I accept that the association OPEN and the property owners cannot be held responsible for any personal, immaterial, or material damage resulting from the nature and configuration of the site.
Keeping my membership fee and my contribution to the residency's operating costs up to date.
Validation of Residency Conditions I have read and understood the terms of this document, and I agree to them.
